Service Agreement

Photography Contract

1. This Agreement is made between ————— [referred to as client], and vendor Captured by Jenise [Referred to as photographer] for Wedding Photography on [[[Date]}} for Wedding starting with getting ready pictures[[[ Adress of location]]] followed by ceremony and reception at [[[ Adress of location]]].

Which includes family and couple pictures at the same location from[[ Time]]]

Wedding Photography and videography package includes photography [[[[[include package details]]] With a delivery of [[[ amount of time to deliver]]]] (business days).

Once payment has been made in full all digital photographs will be delivered within [[time phrame or date]]]] from session, in an online digital gallery through [[[[Insert photo gallery]] The package [[[[Total $000.00]]]

2. Customer can pay in full or chose to book the date by paying a 50% non- refundable retainer .Client can pay for wedding in full or make scheduled payments at any time to the payment link provided. Client also acknowledges and agrees that any goods, digital or tangible, prints, will not be delivered until full payment for services has been made and received by Captured by Jenise.

3. Rescheduling / Late Arrivals Photography time starts at time stated above. In the event that the client requests to reschedule a session, the retainer shall be applied to reschedule the session if note is given at least 2 months prior to scheduled event Rescheduled should be within 1 week.

4. Payment Schedule and Method For your convenience, payments can be made online via Square, Venmo, Zelle using a valid credit card. All sales are final.

5. Photography Copyright All documentation images and video created and provided to client is owned and copy written by photographer and cannot be used or given to any other 3rd party without written permission. Photographer grants rights for personal use in this case for marketing purposes. Client grants photographer rights, including but not limited to publicity, copyright, marketing, illustration, advertising and web content.

6. Artistic Style client agrees to the artistic style of editing and is familiar with the photographer’s portfolio and is requesting services with knowledge of the photographer’s style. Photographers style and work are constantly evolving that photographers unique and artistic nature, that the photos may be different from photographs taken in the past and in creating the photos the, the photographer shall use his personal artistic judgment to create photos consistent with the photographer’s vision of the event Client acknowledges that the photos shall not be subject to rejection of the bases of taste or aesthetic criteria. Photographer does not guarantee the capture of certain events moments poses, because of the event dynamics, obstruction of views of people or objects and the changing nature of the event. Client acknowledges that the number of pictures provided varies depending on weather, lighting of venue, and other unforeseen variables, and furthermore agrees to the amount of processed digital pictures the photographer delivers at their discretion. Any additional services/products requested by the client incurred by photographer will be billed directly to client at cost. All services contracted cannot be deducted, but additional services can be added. Client can request some of the RAW (unedited files) files of the and are still subject to copyright laws for a price of $1500.00. For your convenience, payments to the photographer can be made through Square. Expiration Current event date is valid 1-week post origination date to secure services. If client chooses payment plan, client understands all payments must be made on the date agreed. If client is late on the payment client understands that there will be a $15 late payment assessment.

Touch ups Re-edits Client understands that touch ups and re edits of pictures at the request of client can be made at the rate of $25 per hour. If photographer is unable to do retouch ups client will be billed for third party editor at their rate.

7. Liability It is understood that Photographer is only liable for services completed and provided by photographer and cannot be held liable for the services of other contracted vendors. It is understood that in no event shall photographer be liable for consequential damages of any kind.

8. Cancellation Policy If event is canceled, no portion of the fees paid to Photographer will be returned. If the event is canceled less than 2 months before date, no portion of retainer will be returned in order to compensate for loss of event date. If the event is postponed, services contracted can be applied to a new date if available and an additional retainer fee will have to be paid (refer to Postponement Policy).

Postponement Policy If the event is postponed, all services will cease at time of notification of postponement if no determined new date is provided. Payment schedule will be determined and readjusted post new event date notification. If client requires services to resume, post new event date being established, second payment will be required at time-of-service restart.

9. Responsibility Photographer is not responsible for Acts of God, Force majeure, Natural Disasters, an Act Of

Government such as A Declaration of National or Local Emergency, war, disease epidemic, earthquake, or Other Incidents natural or unnatural, not within the control of the photographer, i.e. accident, death in the family, illness, pregnancy, or sudden tragic circumstance, malfunction of equipment. In such event local laws will be followed. If the photographer is unable to attend for any of the unforeseen circumstances stated above, the client agrees to the replacement photographer that is provided by Photo Craft Studio in.

10. Damage or Loss of Accessories Client agrees to exercise all due care in caring for and preserving the property of the photographer. Clients shall remain responsible for all loss or damage to rentals, up to and including actual replacement value for each missing or damaged item per cost.

11. Arbitration Any dispute arising under or in any way related to this agreement shall be submitted to binding arbitration by the American Arbitration Association in accordance with the Association’s commercial rules then in effect. The arbitration shall be conducted in the state of California. The arbitration shall be binding on the parties and the arbitration award may be confirmed by any court of competent jurisdiction. If legal action is necessary to enforce the terms of this contract the prevailing party shall be entitled to reasonable attorney fees in addition to any other remedies to which that party might be legally entitled. Additionally, the client agrees to opt for arbitration in case of any legal dispute and gives up the right to a jury trial.

Appropriate Conduct/ Safe Working

12. Environment: The Client(s) expressly agree(s) to take best efforts to provide [Photographer] and photographer’s staff with safe and appropriate working conditions. Client agrees to provide Photographer and or if hired the videographer or additional assistant and second photographer with a meal for an event lasting more than 4 hours. Photographer and their asistant, videographer or second photographer will take a 30 minute rest period and two 10 minute breaks which will be taken during periods of down time. In the event of circumstances deemed by either [photographer] or a bystander to present a threat or implied threat of injury or harm to [photographer] staff or equipment, the [Photographer] reserve the right to cancel all services remaining under this Agreement and leave the shoot. At the [photographer]’s discretion, the [photographer] may enact a three-strike policy at the photographer ‘s discretion. If the [photographer] leave the event early due to any offending behavior, the Client(s) expressly agree to relieve and hold [photographer] harmless as a result of incomplete event coverage, or for a lapse in the quality of the [photographer’s] work, and the Client(s) shall be responsible for payment in full.
